General Terms and Conditions of the KeyAccess Authorised Representative Service

Your Compliances offers the Keyaccess Authorised Representative service, which complies with the General Product Safety Regulation (EU) 2023/988 (GPSR). This service is designed for manufacturers and importers who need to introduce and market their products within the European Union.

1. Scope of the Authorised Representative Service

Your Compliances' Authorised Representative service is available to manufacturers and importers outside the European Union, who are required to have this service in place to market their products within the European Economic Area (EEA), as well as to those within the EU who voluntarily wish to appoint an authorised representative.

This service complies with the General Product Safety Regulation (EU) 2023/988 (GPSR), ensuring that Your Compliances is responsible for managing the technical documentation, but the responsibility for product compliance lies with the client unless additional services, such as our CE marking consultancy, are contracted. 2. Client Obligations

The client must provide all the necessary technical documentation to ensure that their product complies with European legislation. This documentation includes:

  • Complete technical files.

  • Compliance test reports.

  • Declaration of conformity.

  • Product label.

  • Instructions for use.

  • List of parts.

  • Any other information required to demonstrate that the product complies with the General Product Safety Regulation (GPSR).

The client is responsible for ensuring that all information and documentation provided to Your Compliances is correct, complete, and accurate.

3. Limitation of Liability

Your Compliances assumes no responsibility for:

  • Non-compliance with European regulations by the manufacturer or importer.

  • The quality or defects of the product.

  • Fines, penalties, or other legal actions that may arise due to the product's failure to comply with the General Product Safety Regulation (GPSR).

  • The accuracy or completeness of the documents provided by the client.

The service offered by Your Compliances focuses on receiving, storing, and forwarding the product's technical documentation to the relevant authorities. However, the responsibility for ensuring that the product complies with European regulations lies with the manufacturer or importer. Your Compliances does not review or guarantee the product’s compliance, nor does it verify the accuracy of the documents provided unless additional services such as our CE marking consultancy are contracted.

4. Duration of the Contract

The Authorised Representative contract will have a minimum duration of one (1) year from the date it is signed. Once this period has been completed, the validity of the technical documentation will be reviewed, and the contract must be renewed in order to continue. If the contract is not renewed, Your Compliances will no longer be responsible for the product.

5. Products We Handle and Those We Do Not

Your Compliances offers representation for a variety of consumer products, but certain products are not covered by our service. Below is a detailed list:

Products we handle:

  • Electronics (e.g., headphones, chargers, portable batteries).

  • Toys (e.g., educational toys, board games).

  • Baby products (e.g., cribs, car seats, educational toys).

  • Sports and fitness equipment (e.g., dumbbells, treadmills).

  • Outdoor furniture (e.g., chairs, tables).

  • DIY tools and equipment (e.g., drills, saws).

  • Kitchenware (e.g., graters, choppers).

  • Furniture and decor items (e.g., folding beds, blinds).

  • Bicycles, scooters, skates, and other cycles.

  • Swimming aids (e.g., flotation devices for learning to swim).

  • Floating leisure items for water use (e.g., inflatable mattresses).

  • Barbecues and lighters.

Products we do not handle:

  • Medical devices.

  • Cosmetics.

  • Raw materials.

  • Heavy machinery.

  • Chemical products.

  • Healthcare products.

6. Fees

Our fees are structured based on the number of products you need us to represent:

  • Service I: Up to 5 products – €199 annually.

  • Service II: Up to 15 products – €299 annually.

  • Service III: Up to 30 products – €499 annually.

  • Service IV: For more than 30 products, please contact us (less than €15 per product).

7. Opportunities for Entities within the European Union

While appointing an Authorised Representative is mandatory for manufacturers and importers outside the EU, businesses within the European Union may also choose to hire this service voluntarily.

Appointing an Authorised Representative within the EU can greatly simplify interactions with authorities and save time, as it reduces complications related to market surveillance. By trusting Your Compliances, any requests from authorities will be handled quickly and efficiently, giving you the peace of mind to focus on growing your business.

8. Termination of the Service

Your Compliances reserves the right to terminate the Authorised Representative service immediately in the following cases:

  • If the client fails to meet their obligations, such as providing the necessary technical documentation.

  • If it is discovered that the products represented do not comply with the General Product Safety Regulation (GPSR).

  • If fraud or falsification is detected in the technical documentation provided by the client.

9. Modifications

Your Compliances reserves the right to modify these Terms and Conditions at any time. Any changes will be notified to the client with 30 days’ notice prior to their application.
